The wellness experience program

• The Kitalay Collective is a membership program that offers its members privileges from dining and spa to family activities while giving them full access to the Kimpton Kitalay Samui’s resort facilities.
• The physical membership cards and certificates of the Kitalay Collective members are valid for up to three or twelve months from the purchase date. Renewal of existing memberships will be made available only at Kimpton Kitalay Samui in the foreseeable future.
• By signing “I AGREE” or by paying the membership fee, or by using the benefits offered as part of the membership program, the member agrees to have read, understood, and accepted the Terms and Conditions of the membership, the use of the Kitalay Collective App, the Privacy Policy and the Website Terms of Use. If the Terms and Conditions are not acceptable to the member, they may exit and refrain from using any features of the Kitalay Collective Program.
• The benefits, rules, Terms and Conditions, Privacy Policy, the Website Terms of Use, and the validity period of the Kitalay Collective Program may be modified, withdrawn, added, or deleted, with or without prior notice to members. All decisions taken by Kimpton Kitalay Samui hereof shall be final and binding to all members of the Kitalay Collective Program.

• The Kitalay Collective membership application is only open to individuals aged 18 years and above or individuals at the age of majority in their country of residence. Applicants are held responsible for their compliance with all applicable laws and regulations.
• By enrolling and participating in the Kitalay Collective Program, the member agrees that Kimpton Kitalay Samui may contact them by telephone, text message, electronic mail, instantaneous chat, or any other platforms where the member has provided contact information.
• An applicant can enroll as a new member or renew their membership as an existing member by creating an account at Kimpton Kitalay Samui. New and existing members are obligated to provide valid, accurate, complete, and updated personal information, including their first and last names, mobile number, and e-mail address, before using services and benefits offered in the Kitalay Collective Program.
• The Kitalay Collective membership card cannot be used for commercial purposes, unlawful, immoral, illegal purposes, or any other purposes than those stated in the Terms and Conditions.

• Membership cards are only issued to primary cardholders and authorized secondary users and are only valid for three or twelve months, depending on the membership type. Membership is renewable only at Kimpton Kitalay Samui once the current one has expired.
• All vouchers are redeemed in one single usage. The difference in voucher value and service fee will not be compensated in cash or other forms of payment and cannot be exchanged for cash or any other services.
• Members are required to make direct reservations with the resort. Redemption, modification, or cancellation of reserved services must be executed by the member for whom the reservation is made. Once a voucher is used to secure a reservation, it cannot be used to make another one until the original voucher has been redeemed, modified, or canceled. In an event of a no-show, the voucher will be considered to have been redeemed.
• Members can redeem their benefits once they arrive at the resort. It is the responsibility of the members to monitor the validity period of their vouchers for a timely redemption. The resort will not be held accountable or responsible for an untimely redemption of vouchers which could result in voucher expiration and members losing access to certain benefits.

• Benefits provided under the Kitalay Collective Program are not available at other IHG Hotels.
• Dress codes and child policy may apply for certain services. Alcohol is only served and sold to guests of the minimum drinking age in compliance with all applicable laws and regulations.

DINING BENEFITS

• The dining benefits of the Kitalay Collective Program are explained in full in the Kitalay Collective Handbook. Members can make their reservations at any of the selected restaurants at the resort. However, the resort is not liable for the cancellation of reservations or the decline of dining benefit redemption at any of the restaurants.
• Eligible purchases and redemption of dining benefits in the Kitalay Collective Program exclude (i) service charges and taxes; (ii) purchases made during the blackout dates or any other dates as specified by Kimpton Kitalay Samui; (iii) catering and event purchases; (iv) takeaway, delivery, and room service orders; and (v) special promotions, discounts, or other bundled food and beverage purchases. Kimpton Kitalay Samui shall determine, at their sole discretion, whether a purchase constitutes an eligible purchase. The member herein agrees to abide by and be bound by such determination.

ACCOMMODATION BENEFITS

Reservations

• By making a reservation at Kimpton Kitalay Samui under the Kitalay Collective Program, the member (i) agrees to be bound by all of the resort’s standard terms and conditions and by any other policies, terms, and conditions that may apply, and (ii) authorizes Kimpton Kitalay Samui to use their personal information for reservation purposes.
• All reservations made at Kimpton Kitalay Samui are subject to availability. It is recommended to make a reservation with the resort in advance and clearly state the membership benefits to be redeemed to avoid any disappointment upon arrival.
• Accommodation benefits are issued in voucher form. Each voucher is valid for one-time use only.
• Redemption of vouchers and promotional codes can only be made 30 days before the arrival date or as stated on the voucher certificates or the terms and conditions applicable to the promotional codes.
• Early check-ins, late check-outs, or requests for specific room types are subject to availability and cannot be guaranteed at the time of reservation.
• Kimpton Kitalay Samui reserves the right to request proof of identity (e.g., passports or national identity cards) from any person checking in. Kimpton Kitalay Samui reserves the right to deny check-in for any guest who is unable to provide the required proof of identity.

Cancellation Policy

• Cancellation of reservations varies depending on the room rates, occupancy levels, or other terms and conditions as dictated by Kimpton Kitalay Samui. The resort’s cancellation policy is generally provided with the reservation confirmation. A cancellation or modification of a reservation must adhere to the terms and conditions stated in the cancellation policy.
• Notwithstanding the foregoing, it is the resort’s standard policy that any amendments to or cancellations of any reservations may be subject to certain retention fees following the standard cancellation terms and conditions.

SPA, HEALTH CLUB, AND POOL FACILITIES

• The Kitalay Collective benefits can be enjoyed only at the resort, on available times and dates, and with a restricted number of guests. The selection of services that members are eligible to receive and/or redeem depends on the type of membership purchased. Members are advised to read the terms and conditions of their eligible benefits in the Kitalay Collective Handbook.
• Members are eligible to make reservations for services and use facilities included in their membership package only. Access to pool facilities and the health club is subject to house rules.
• Eligible purchases include (i) spa benefits in services and retail purchases; (ii) health club benefits in facility access and usage of changing room with showers, steam room, and sauna; and (iii) access to pool facilities.
• Eligible purchases of spa, health club, and pool benefits made under the Kitalay Collective Program exclude (i) service charges and taxes; (ii) purchases made during the blackout dates or any other date as specified by Kimpton Kitalay Samui; (iii) purchases for specific events such as weddings, conferences, or special events; (iv) purchases made in conjunction with other prevailing offers, special promotions, or discount programs; and (v) bookings and reservations made with intentions to resell, advertise, or market the reservations (whether online or otherwise) to third parties. Kimpton Kitalay Samui shall determine, at their sole discretion, whether a purchase constitutes an eligible purchase, and the member agrees to abide by, and to be bound by, such determination.

CANCELLATION

• Member who wishes to discontinue their membership is required to submit a written request for cancellation and refund (if applicable) within 15 days of becoming a member. Upon submission of a written request, termination is irreversible. The membership account of the concerned member will be closed, and the total amount of the membership fee will be refunded, provided that none of the benefits in the Kitalay Collective Program is used and that the refund requested adheres to the given timeline. The refund will be processed upon the receipt of the membership card or certificate (if any) and the written request for membership cancellation.

TERMINATION

• Membership will end automatically upon the death of the member.
• Kimpton Kitalay Samui may immediately, without notice or limitation, terminate any membership to the Kitalay Collective Program at its sole discretion without assigning any reason or if the member: (i) violates the Terms and Conditions, the Privacy Policy, the Website Terms of Use, or any other applicable terms and conditions, or appears to be utilizing the benefits under the Kitalay Collective Program in a manner inconsistent with these Terms and Conditions or the intent of the Kitalay Collective Program; (ii) fails to promptly pay any applicable dues; (iii) is suspected or found to be acting in an abusive or fraudulent manner or engaging in any conduct that artificially, improperly, or deceptively impacts the use of membership benefits (including and without limitation, the use of any “bot,” macro, or other automated means of participating in the Kitalay Collective Program); (iv) attempts to transfer their account to another member or a third party, except with the express written permission from Kimpton Kitalay Samui; (v) engages in actions that misrepresent the Kitalay Collective Program and its benefits; (vi) disturbs other guests or otherwise disrupts or impairs the daily operation of Kimpton Kitalay Samui; (vii) acts in a manner detrimental to the resort and its staff, guests, or any third parties (including any manner that is abusive, harassing, threatening, derogatory, disrespectful, lewd, obscene, offensive, or otherwise inappropriate, as determined by Kimpton Kitalay Samui at its sole discretion); (viii) acts in any manner inconsistent with the applicable law; (ix) allows their membership account to remain inactive for a period of two months or more; (x) files for insolvency or bankruptcy, or is otherwise subject to a bankruptcy proceeding.
• Membership cards or vouchers must be returned to Kimpton Kitalay Samui upon membership termination.
• Members agree that Kimpton Kitalay Samui has the right to monitor membership accounts, at any time and without prior notice, for compliance with the Terms and Conditions. Any fraud or abuse in relation to the Kitalay Collective Program is subject to appropriate administrative and/or legal actions, including termination of membership.

• If the Kitalay Collective Program is terminated, all unredeemed benefits will be forfeited without the imposition of any obligation, refund, or liability on the behalf of Kimpton Kitalay Samui, unless otherwise announced by the resort. Upon termination, the resort is under no obligation to offer a replacement program. Kimpton Kitalay Samui reserves the right to determine, at its sole discretion, how to handle the benefits offered in the Kitalay Collective Program and the activities occurring after the effective date of termination. Such discretion may include declining to provide the aforementioned benefits after the termination date.

• Members may request assistance from the dedicated program contact center. The operating hours for the center are from 8 a.m. to 6 p.m. every day except on public holidays.
